- Does this letter make the dismissal fair?
- No. It records a decision, it does not make it fair. For a performance or conduct dismissal you need a valid reason, the reason put to the employee, a chance to respond with a support person, and warnings first. If that has not happened, get advice before you send it.
- How is notice handled?
- You state the notice period, which must meet or beat the National Employment Standards minimum for the employee's service, plus any longer award or contract notice. For serious misconduct, summary dismissal applies and no notice is owed.
- Can a small business use it?
- Yes. If you employ fewer than 15 people the letter suppresses National Employment Standards redundancy pay, and you should complete and keep the Small Business Fair Dismissal Code checklist as your evidence.
